Welcome to Indulge Cakes. These Terms and Conditions govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.
1. General
Indulge Cakes is a Canadian bakery specializing in handcrafted cakes, desserts, and custom cake creations for various occasions.
By using our website, you confirm that you are at least the age of majority in your province or territory of residence, or that you have permission from a parent or legal guardian.
We reserve the right to update these Terms and Conditions at any time without prior notice.
2. Orders
All orders are subject to acceptance and availability.
When placing a custom cake order, it is your responsibility to provide accurate details, including:
- Event date
- Pickup or delivery information
- Cake size
- Design preferences
- Flavor selection
- Contact information
We reserve the right to refuse or cancel any order if necessary, including where incorrect pricing, product availability, or other unforeseen circumstances occur.
3. Pricing
All prices displayed on our website are listed in Canadian Dollars (CAD) unless otherwise stated.
Prices may change without prior notice. However, once your order has been confirmed, the agreed price will remain unchanged unless modifications are requested by the customer.
Applicable taxes will be calculated during checkout where required.
4. Payment Methods
We currently accept the following payment methods:
- Manual Bank Transfer
- Cash on Delivery (COD) (where available)
- Credit and Debit Cards securely processed through Stripe
For Manual Bank Transfers, orders will only be confirmed once payment has been received and verified.
Card payments are processed securely through Stripe. We do not store your credit or debit card information.
5. Order Changes and Cancellations
Due to the custom nature of many of our products, requests to modify or cancel an order must be made as soon as possible.
Once baking or decorating has begun, cancellations or significant design changes may no longer be possible.
If an order has already been completed or prepared, refunds may not be available.
6. Pickup and Delivery
Customers are responsible for collecting orders at the agreed pickup time unless delivery has been arranged.
If delivery is selected:
- Delivery times are estimates only.
- Someone must be available to receive the order.
- Once the order has been delivered to the provided address, responsibility for the product transfers to the customer.
Please inspect your order upon receipt and notify us immediately of any concerns.
7. Custom Cake Designs
Every handcrafted cake is unique.
While we make every effort to replicate reference images or requested designs, slight variations in decoration, colour, and finishing details may occur due to the handmade nature of our products.
These variations do not constitute defects.
8. Allergies and Ingredients
Our products may contain or come into contact with common allergens, including but not limited to:
- Milk
- Eggs
- Wheat
- Soy
- Peanuts
- Tree nuts
While we take reasonable precautions, we cannot guarantee an allergen-free environment.
Customers are responsible for informing us of any allergy concerns before placing an order.
9. Refunds and Returns
Due to the perishable and custom-made nature of our products:
- All sales are generally final.
- Refunds are not provided for products that have been accepted, collected, or delivered.
- If there is an issue with your order due to an error on our part, please contact us within 24 hours of receiving your order so we can review the matter and work toward a fair resolution.
10. Product Availability
Product availability may change without notice.
If an ingredient or product becomes unavailable, we reserve the right to substitute ingredients of equal or greater quality where appropriate or contact you to discuss suitable alternatives.
11. Intellectual Property
All content available on this website, including but not limited to:
- Logos
- Images
- Product photographs
- Cake designs
- Graphics
- Text
- Website design
is the property of Indulge Cakes and may not be copied, reproduced, distributed, or used without our prior written permission.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Indulge Cakes shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our website or products.
Our maximum liability shall not exceed the total amount paid for the applicable order.
13. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
14. Changes to These Terms
We reserve the right to amend these Terms and Conditions at any time.
Updated versions will be posted on this page with a revised Effective Date. Continued use of our website constitutes acceptance of any revised Terms.
